All services provided by PROJECTS BY PEGGY may be used for lawful purposes only.
Transmission, storage or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material that is threatening or obscene, material that is with "adult only" content, or material protected by trade secrets and other statute.
PROJECTS BY PEGGY will be the sole arbiter as to what constitutes a violation of this provision.
PRIVACY
PROJECTS BY PEGGY is committed to your privacy and the protection of your information. PROJECTS BY PEGGY will never share, sell or rent individual personal information with anyone without your advance permission or unless ordered by a court of law. Information submitted is only available to employees or vendors managing this information for purposes of contacting you or sending you emails based on your request for information.
REFUND POLICY
PROJECTS BY PEGGY offers an unconditional 30-day money-back guarantee on NEW HOSTING ACCOUNTS (does not apply to renewals). If the CLIENT wishes to cancel a NEW hosting account within the initial 30-day period for any reason, he/she has to notify PROJECTS BY PEGGY via e-mail (support@projectsbypeggy.com). Payment will be refunded within 7-10 business days.
Since all .com, .net, .org, .us, .biz and .info domains registered cannot be refunded, they will be subject to the $15.00 annual domain registration fee. As the CLIENT is the sole owner of the registered domain name, arrangements can be made to transfer its registration to another provider.
PROJECTS BY PEGGY does not offer any partial or prorated refunds after the initial 30-day money-back guarantee period.
If a CLIENT disputes a setup/renewal charge for any account, PROJECTS BY PEGGY will not re-activate the service, unless the CLIENT covers all fees involved, including the chargeback fee and any other transaction fees.
ACCOUNT RENEWAL POLICY
PROJECTS BY PEGGY does not renew accounts automatically. For the CLIENT's convenience, PROJECTS BY PEGGY will send an invoice to the client’s email address on file. The CLIENT is ultimately responsible for prepayment and renewal of the hosting account and domain registration.
DISPUTE RESOLUTION POLICY
In case of ownership dispute, PROJECTS BY PEGGY reserves the right to be the sole decision maker in settling the dispute. The following guidelines will be used to determine the rightful owner of the disputed hosting account or domain name:
- By default, ownership is granted to the person who paid for the hosting account.
- If the identity of the payee as discussed above cannot be confirmed, PROJECTS BY PEGGY will attempt to determine the owner in other ways, which include but are not limited to investigation the content hosted under the respective hosting account or domain name, and investigation of the sequence of annual payments for the disputed service.
- PROJECTS BY PEGGY will consider a court decision overruling in case of ownership dispute, and will always comply with such a decision.
INDEMNIFICATION
CLIENT agrees that it shall defend, indemnify, save and hold PROJECTS harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees associated with PROJECTS’ development of the CLIENT’s web site. This includes Liabilities asserted against PROJECTS, its subcontractors, its agents, its CLIENTs, servants, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by the CLIENT, its agents, employees or assigns.
CLIENT also agrees to defend, indemnify and hold harmless PROJECTS against Liabilities arising out of any injury to person or property caused by any products or services sold or otherwise distributed over the CLIENT’s web site. This includes infringing upon on the proprietary rights of a third party, copyright infringement, and delivering any defective product or misinformation which is detrimental to another person, organization, or business.
DISCLAIMER
PROJECTS BY PEGGY, at its sole discretion, may change these terms and conditions at any time. By using PROJECTS BY PEGGY’s services the user agrees that PROJECTS BY PEGGY may (1) revise these terms and conditions; and (2) change the services provided.
Any such revision or change will be binding and effective immediately on posting of the revised terms or change to the service(s) on PROJECTS BY PEGGY’s web site, or on notification to the CLIENT by e-mail. The CLIENT agrees to review PROJECTS BY PEGGY’s web site, including these terms, periodically to be aware of any such revisions. If the CLIENT does not agree with any revision, he/she may terminate the services at any time by notifying PROJECTS BY PEGGY by e-mail. Notice of the CLIENT's termination will be effective on receipt and processing by PROJECTS BY PEGGY.
The CLIENT agrees that, by continuing to use PROJECTS BY PEGGY’s services following notice of any revision to this Agreement or change in service(s), he/she abides by any such revisions or changes.
The content available through this site is the sole property of PROJECTS BY PEGGY and is protected by patent, copyright, trademark and other intellectual property laws. You agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate the content received through this site to anyone, including but not limited to others in the same company or organization without PROJECTS BY PEGGY’s express prior written consent.
REFUSAL OF SERVICE
PROJECTS BY PEGGY reserves the right at its sole discretion to refuse or cancel service. Violation of any of PROJECTS BY PEGGY could result in a warning, suspension, or account termination. Submitting fake personal information can also be grounds for suspension or termination.
LIMITED LIABILITY
CLIENT agrees that any material submitted for publication will not contain anything leading to an abusive or unethical use of the Web Hosting Service, the Host Server or PROJECTS. Abusive and unethical materials and uses include, but are not limited to, pornography, obscenity, nudity, violations of privacy, computer viruses, harassment, any illegal activity, spamming advocacy of an illegal activity, and any infringement policy.
CLIENT hereby agrees to indemnify and hold harmless PROJECTS from any claim resulting from the CLIENT’s publication of material or use of those materials.
It is also understood that PROJECTS will not publish information over the Internet, which may be used by another party to harm another. PROJECTS will also not develop a pornography or otherwise unethical web site for the CLIENT. PROJECTS reserves the right to determine what is and is not unethical content.
